''Bharat Bhagya Vidhata" .this hymns in my ears since first time i sang in my school prayer in pre nursery. Never reprimanded of the meaning of what seemed to be a truly enthusiastic display of nationalism. Times passed by and i kept wondering what actually it meant.The days passed by and i have reached a stage where i m striving to understand what it means.
Sunday , 25th Aug 2013 a group of people gathered outside " Academy of fine arts" Rabindra Sadan kolkatta. They were stripping one by one.The group called It Self Hridaya- Men With Heart. Camera men and media personnel ready to cover them.Wondering what's wrong with these men on Sunday afternoon where other fellow men are enjoying a cup of evening tea, with Bengali delicacy.They are out with placards.
Strip to protest...wonder what made them do so. and a roar came. "Roll back IrBM." and group chanted the same.All of a Sudden entire environment became electric. Almost every passerby started looking at nudity of these men. Their Slogans synchronized & uproar became heavier & louder.

It was explained -UPA Govt has proposed Amendment in. " Hindu Marriage Act 1956", to include a clause of "No fault Divorce" For Speedy breakdown of marriage between warring Spouses. Sounds reasonable though why the Hell these guys are protesting as No point Holding individuals tied together if they cant co-exist.
The Bill also made provision that A Divorcing wife would be entitled to claim Share in Husbands inherited / Inheritable Property. The premise being a divorcing Wife has no Shelter( Read Property) to thrive/Survive once marital relationship is over. Sounds quite Concerning.
Prima facie it looks a bold move for wife Empowerment. Why these Nude men( in Gamcha) on Streets?? Are they insane and gone out of their wits Shouting "Roll back IrBM."??
Looking at their "Right to be heard" whats this All about and why is this protest?.
The Entire Premise of "IrBM" is that women don't have Shelter post a Marital Discord appears to be Concerning . Statistics Shared by law minister says that Only 2% Women own property. Hindu Succession Act and Amendment 2005 , allow daughters to Claim equal Share in parental property.How Come Only 2% women own Property??? A daughter has a Fair Share in parental property Legally She is Entitled to parental property & this very government brought this amendment 8 years back. Now munching their words the same daughter when gets married don't have any asset which itself is a paradox.
She wont Claim and they wont give this is the underlying Statement. An estranged wife has no place to go and no one to rely ... how far that's true.Legally??? She has a fair Share in Parents Property. If She is denied from her parents , Are they not doing cruelty to their Daughters. Only "Bhagya Vidhata" can Answer??
Now this law is impossible to implement due to emotional reasons Parents have a Place of God and In laws demons in Indian Society. Wife is Gospel of truth and Husband and in laws are Her perpetrators.
Marital discord and Separation happens and it's justified that the Individuals should be allowed to part way Amicably. IrBM says it's "No fault Divorce" Clause. Truly Heartening to learn this. These Insane Men are Protesting to get media Attention it Seems.
" No Fault divorce" after Separation of 3 years in a marriage. Both Husband & wife can invoke this Clause for getting divorce. Now a Wife can veto the Clause Stating "financial Hardship" on Contrary husbands cant.

In a Marital discord Almost All the Divorce cases are Supported with allegations by wife. Cruelty by Men popularly known as 498a .This sends Husband and in laws behind bar just on a Complaint by Estranged wife. followed by bouquet of allegations and cases under DV act 2005 , 125 CRPC, HMA 24and Social and personal attacks many more.
Obvious assumption is India is patriarchal Society & wife is a Sufferer & husband is Perpetrator.
" No Fault divorce" is the Clause for getting Separation and Financial gains remember men has to over come Wife's Financial hardship and Cruelty she faces from her own very parents as they wont give her any property under Hindu Succession ACT. Thus he is bound to Share his assets income valuables , reputation and much more. How ever Very beautifully on the one side, Her exit is rewarding & Her allegation Stands as it is. When the same women claim that the Divorce is "No Ones Fault" Hoe Come all Allegation Stand true.
Either Her Allegations are true or No fault claim. Since She has initiated criminal Cases and proceeding, Can She be punished for Filing false cases as either of them can be only true. How can both Conditions Stand Tall??. Only because she is Daughter-of- Law( DIL).
What happened to wits of the Politicians. They say this law will cover only Hindu Married Men and Special marriage Act. Are the Women of other Communities immunized from the assumptions and premises of this law.Uniform Civil Code sounds a distant dream here. Women organisations and govt will only cry Wives are harassed. An emotional card to win the world. Throwing Mankind to Abject Poverty.
Honorable Law minister mentions that Only 2% of Women own Asset. Logic Says that if the distribution of asset is to be made, World wide, Practice is to consider the contribution of both husbands and wife while proceeding with division. In all fairness Since only 2% of women own asset whats the problem in considering wife's Asset and Income worth while going in for such a division. Make it gender neutral and replace The word "Husband or Wife" with "Spouse". In fact the bill provides No Safe guard in case of fraudulent Marriages either men at purely to Extort financial gains taking advantage of pro wife laws.
"Biyee Mane Sansaar Sampatii nai" another uproar came and the rains too. Marriage means Family not property was the out cry. These Men Seems to have take this protest very heartily and come out in Gamcha to forecast their future post this law.
"Bharat Bhagya Vidhata" the skies cried along with these protesters, thunders and flashes all around . The Rain god ( Vidhata ) wasn't pleased at all. UPA Govt ( Representatives of Bharat) is hell bent to get
this approved. Indian Men Kind fate ( Bhagya ) is in Doldrums. I could slightly make out now the true essence of " Bharat Bhagya Vidhata".

Very apt n articulate. Today the fate of Indian men are like dat of Damocles with a sword constantly hanging on their head from the mmoment he agrees to tie the knot. Unfortunate part is majority of Indian men are blissfully unaware of this ticking time bomb which can blow up on him or his friends or relatives without any fore warning. Tine has come for men to rise from this stupid n archaic idea of chauvinism n fights for their rights.
ReplyDelete#Irbm is a double edged sword. If law can solve the problem at Bedroom then 498a can also serve its purpose. Why still 498a is there since last 27 yrs ? Why so many false 498a cases ? If 498a have already fulfilled its purpose, why still we need it ? Any Answer ?
ReplyDelete#Irbm will multiply the family destruction compared to IPC 498a. If we ignore past experience, it is solely our fault and we can't blame other for the damage.
When 498a/DV/crpc-125 is there why don't we have just a "single Law" which ensure the family bonding ? Any answer please ?
fully agree with the author. In this new age wave of feminism, India has forgotten that women in Hindu religion has always been recognized as a source of power, wealth and knowledge.

Our once famed rock solid family system is now in danger...west is trying to destabilize the peace of people.....the very concept of savings which was till date our best defence against rising inflation is going to be eroded....

Such laws like IrBM, not only shakens the very pillars of our Indian society, but soon going to make it fall.
